The BIA is an administrative system that considers appeals to immigration court decisions. For an appeal to be evaluated it must arrive at the BIA in Virginia within 30 days of entry of the immigration judge's final order. In the appeals process, you have the right to state your disagreement and to provide additional information, briefs and schedules.
Should your appeal be denied by the Board of Immigration Appeals, you have the option to file an appeal with the Ninth Circuit Court of Appeals in California. Again, certain stipulations must be met such as the court receiving the appeal within 30 days from the time of entry of the detrimental order from the BIA. A brief must be submitted to state your argument, and there may be an invitation to present an oral argument before a panel. The panel will issue a decision within a few months.
If the Board of Immigration Appeals agrees with your petition, it will either grant relief or remand your case to a lower body to make a ruling consistent with their findings. If your appeal is denied by the Ninth Circuit Court, your final option is to file a motion to reopen/reconsider (MTR).
