There are two types of cancellation of removal: lawful permanent resident/green card (LPR) and non-lawful permanent resident (non-LPR). For LPR, you must be able to demonstrate seven years of continuous residence in the United States. If you have committed crimes, they must not be aggravated felonies. For non-LPR proceedings, you will have to prove 10 years of continuous residence in the US. For both LPR and non-LPR, you must have an immediate relative in the US who is a lawful resident or citizen in order to show extreme and unusual hardship to that individual(s) should you be removed from the United States.
Through the Nicaraguan and Central American Relief Act (NACARA), a special rule for cancellation exists. If you, as an LPR, belong to one of the NACARA countries or one of certain former Soviet Republics, you may qualify for a redacted version of the regular cancellation of removal process. This provides an expedited way to obtain residence in the United States. Our attorneys can help you determine if you qualify.
Cancellation of removal can be instituted for cases of extreme and unusual hardship. You must be able to show that your removal/deportation from the United States to your home country would cause extreme and unusual hardship to a relative in the US. An immigration judge has the discretion to grant this form of cancellation.
