If you have entered the United States on a K1 visa, you must marry your petitioning fiancé within 90 days of arrival. It is important to remember that you are not allowed to marry anyone other than the person who filed the petition for you. If you choose not to marry your fiancé within that set period of time, you will be considered removable and your petition will be eliminated.
From the time your visa application is granted, married individuals will receive conditional permanent resident status for two years. Ninety days prior to the expiration of your status, you and your spouse must file paperwork with the government stating that you are indeed married and intend to remain married. If your application is granted, you will be given permanent residence with removal of conditions.
Marriage and K1 visas can be issued through the consular process when the petitioner is in the United States and the beneficiary is still abroad. The citizen (petitioner) will apply to bring the fiancé, fiancée or spouse from a foreign country, while the beneficiary will interview at their local US embassy. The beneficiary should be ready to provide documentation to support the genuineness of the relationship including how the couple met, where they will live and proof of the relationship's existence prior to filing.
