Generally, you will need to have a pending job offer to obtain permanent labor (PERM) certification. This requirement may be waived if you have exceptional talent or skills that can “advance the goals and initiatives of the United States”.
There are rules and restrictions concerning your level of education and experience that will dictate whether you qualify to get a job and be sponsored by an employer. There are also rules governing United States employers offering jobs to noncitizens. Companies are required to prove there are no American workers available with the needed skill set, and companies must demonstrate financial stability.
Once a job offer has been extended to you, anyone, including our attorneys, can apply on your behalf for the permanent labor certification. Processing priority is given to those with more advanced levels of education and experience. The fewer unique qualifications you possess, the longer it will take in the quota system for your petition to become current and for a green card to be awarded.
